These Terms & Conditions (“Terms”) govern the access to and use of YourTurn Medical (“the Service”), operated by YourTurn (“we”, “us”, or “our”), accessible at med.yourturn.lk and associated subdomains. By registering a clinic account or using the Service, you agree to be bound by these Terms.
1. Acceptance of Terms
By accessing or using the Service, you confirm that you are at least 18 years of age, that you are authorised to act on behalf of the clinic or medical practice you are registering, and that all information you provide is accurate. If you do not agree to these Terms, you must not use the Service.
2. Service Description
YourTurn Medical provides a cloud-based queue management system for medical clinics, GP practices, specialist facilities, and other healthcare providers. The Service includes:
- Real-time patient queue management for one or more doctors/rooms
- SMS notification system for queue position updates
- Patient self-tracking via unique session links
- TV/display board for waiting room screens
- Online pre-booking for patient appointments
- Post-visit patient review collection
- Analytics dashboard for session reports
3. Account Registration & Security
You are responsible for maintaining the confidentiality of your account credentials, including passwords for all staff accounts created under your clinic. You must:
- Provide accurate and complete registration information
- Promptly update information if it changes
- Notify us immediately at info@yourturn.lk if you suspect unauthorised access
- Ensure that staff accounts are used only by the intended individuals
We reserve the right to suspend or terminate accounts that violate these Terms or show signs of fraudulent activity.
4. Acceptable Use
You agree not to:
- Use the SMS feature to send messages unrelated to patient queue notifications at your clinic
- Enter false or fictitious patient data into the system
- Share your login credentials with individuals outside your clinic
- Attempt to access data belonging to other clinics
- Reverse-engineer, copy, scrape, or resell any part of the Service
- Use the Service in a manner that violates any applicable Sri Lankan law or regulation
5. Patient Data Responsibilities
As a clinic using YourTurn Medical, you are the data controller for patient information entered into the system. You are responsible for:
- Obtaining appropriate consent from patients before collecting their mobile numbers
- Ensuring patients are informed that SMS notifications will be sent regarding their queue position
- Responding to patient requests to access, correct, or delete their data
- Complying with applicable data protection laws, including the Personal Data Protection Act (PDPA) of Sri Lanka when enacted
YourTurn processes patient data only as a data processor acting on your instructions and in accordance with our Privacy Policy.
6. Subscription Plans & Billing
YourTurn Medical is offered on free and paid subscription plans. Paid plans are billed monthly or annually as selected during checkout. Payments are processed securely through PayHere. By subscribing to a paid plan, you authorise the applicable charges to be applied to your chosen payment method.
Prices are denominated in Sri Lankan Rupees (LKR). We reserve the right to change pricing with at least 30 days' notice. Your continued use of the Service after a price change constitutes acceptance of the new pricing.
7. SMS Credits
SMS notifications consume credits from your plan's daily allowance or from purchased SMS add-on packs. Credits are non-transferable between clinics and unused daily credits do not roll over. Add-on credit packs purchased via PayHere are non-refundable once credits have been partially consumed. See our Refund Policy for details.
8. Free Plan Limitations
The free plan is provided as-is with limited features and lower daily SMS limits. We reserve the right to modify, restrict, or discontinue the free plan at any time with reasonable notice.
9. Intellectual Property
All software, design, branding, and content comprising the YourTurn Medical platform are owned by or licensed to us. You retain full ownership of all clinic and patient data you input. You grant us a limited, non-exclusive licence to host and process that data solely for the purpose of providing the Service to you.
10. Service Availability
We aim to maintain high platform availability but do not provide an uptime guarantee. Planned maintenance, emergency patches, and force majeure events may cause temporary unavailability. We will provide advance notice of scheduled maintenance where possible.
11. Disclaimer of Warranties
The Service is provided “as is” and “as available” without warranties of any kind. We do not warrant that the platform will be error-free, uninterrupted, or suitable for any particular medical use case. YourTurn is a queue management tool and is not a clinical, diagnostic, or patient records system.
12. Limitation of Liability
To the fullest extent permitted by law, YourTurn shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of or related to your use of the Service. Our total aggregate liability shall not exceed the amounts paid by you in the three months preceding the claim.
13. Termination
You may cancel your subscription at any time via the Settings page. Cancellation takes effect at the end of the current billing period. We may suspend or terminate your account immediately for material breaches of these Terms. Upon termination, your data is retained for 90 days before permanent deletion, during which you may request an export.
14. Governing Law
These Terms are governed by and construed in accordance with the laws of Sri Lanka. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Sri Lanka.
15. Amendments
We may update these Terms from time to time. We will notify registered clinic administrators of material changes by email. Continued use of the Service after the effective date of changes constitutes acceptance of the updated Terms.
